Membership Agreement and Website Use Agreement
1. Parties
This agreement is entered into between Cartographero Mapping and Software Technologies Ltd. (“Publisher”) on one side, and the natural person or legal entity who registers or accesses the website www.cartographero.com (“User” or “Member”) on the other side.
2. Definitions

Site: The website www.cartographero.com managed by Cartographero.

Member: A natural or legal person who registers on the Site and benefits from the services.

User: Any person who visits the Site, whether registered or not.

Content: Any type of writing, visual, video, or other material published on the Site.

Activation Process: Completion of membership activation procedures.
-
Personal Data: Data related to the Member such as identity, contact information, and IP address.
3. Subject of the Agreement
The subject of this agreement is to define the terms and conditions under which Members and Users benefit from the services on the Cartographero website, as well as the mutual rights and obligations of the parties.
4. Membership Conditions and Terms of Use
4.1 Membership Conditions

Natural persons who wish to become members must be at least 18 years old.

For applications on behalf of legal entities, the applicant must have legal representative authority.

Information provided in the membership form must be accurate, complete, and up-to-date. Any misinformation is the sole responsibility of the Member.
4.2 Member’s Responsibilities

The Member is responsible for the security of their password and account.

The Member is liable for all transactions resulting from unauthorized use of their account by third parties.

The Member commits to using the Site only for lawful and ethical purposes.

The Member agrees not to engage in any activities on the Site that infringe upon the rights of third parties.
4.3 Publisher’s Authorities

Cartographero reserves the right to approve or reject membership applications.

Cartographero may suspend or terminate membership if the Member violates the terms of use.

Cartographero reserves the right to change, update, or discontinue the Site’s content and terms without prior notice.
5. Website Usage Rules
5.1 General Usage Terms

Accessing or using www.cartographero.com constitutes acceptance of these Terms of Use.

The User agrees to comply with the applicable Terms of Use from the moment of first access.

Cartographero has the right to change, reorganize, or suspend the Site and Terms of Use at any time without prior notice. Such changes take effect immediately upon publication.
5.2 Content and Services Provided by the Site

Cartographero holds intellectual property rights over all content, visuals, written material, technical data, and software provided through the Site.

No material on the Site may be copied, reproduced, published elsewhere, or sold without written permission.

The Site content cannot be used for commercial purposes; unauthorized commercial use may result in legal action.
5.3 Disclaimer of Liability

5.4 Security and User Responsibility

Users must not misuse the Site or harm its technical systems.
6. Content Creator and Author Agreement
6.1 Parties
This agreement is made between Cartographero Mapping and Software Technologies Ltd. (“Publisher”) and the individual or entity contributing as a content creator (“Author”).
6.2 Subject
The subject of this agreement is the publication of articles, blog posts, visual content, descriptions, or technical texts produced by the Author on www.cartographero.com, including intellectual property rights transfer and publication rules.
6.3 Intellectual Property Rights

The Author agrees to transfer all copyrights of the provided content to Cartographero indefinitely, without geographical or other limitations.

These rights include reproduction, distribution, representation, modification, and public communication.
6.4 Originality and Responsibility

The Author guarantees that the content is original and does not infringe on third-party rights.

Even if AI tools are used in content creation, the Author assumes all editorial and legal responsibility.
6.5 Usage Rights

Cartographero has the right to remove, edit, translate, and commercially use the produced content.
6.6 Confidentiality

The Author agrees to keep all information acquired during content creation confidential.
6.7 Compensation
-
If payment is involved, it will be separately agreed upon in writing.

This agreement does not guarantee automatic compensation.
6.8 Dispute Resolution

Disputes arising from this agreement will be subject to the jurisdiction of Istanbul Anatolian Courts and Enforcement Offices.
7. Intellectual Property Rights and Copyright Protection
7.1 General Provisions

Cartographero owns or is licensed to all intellectual and industrial property rights regarding the Site’s design, content, graphics, trademarks, logos, icons, and related materials.

No part of the Site content may be altered, copied, reproduced, sublicensed, published on other platforms, downloaded, transmitted, or distributed without prior written permission and source attribution.
7.2 Content Usage Rules

Commercial use of products, visuals, and other content from the Site on other websites is prohibited.
-
Content may be shared with third parties only for personal informational purposes, with clear indication of Cartographero as the source and compliance with the terms.
7.3 Digital Security and Monitoring

Cartographero employs digital watermarking, hash verification, and metadata tracking technologies to protect content.

Unauthorized use, copying, distribution, or alteration will result in legal proceedings under Law No. 5846 on Intellectual and Artistic Works and other relevant legislation.
7.4 Right to Amend

Cartographero reserves the right to modify, remove, or restrict access to any Site content at any time.
8. Data Security and Privacy Policies
8.1 Data Security

Cartographero applies strong encryption (SSL/TLS), firewalls, and regular security updates to protect user information against unauthorized access, misuse, alteration, or destruction.
8.2 Protection of User Data

Data collected during registration, membership, orders, or communication is accessible only to authorized personnel within the system.

All user data is processed in accordance with the Turkish Personal Data Protection Law No. 6698 (“KVKK”).
8.3 Secure Payment Infrastructure

All payment transactions are processed through payment providers compliant with international PCI DSS standards (e.g., PayTR, Iyzico).

No credit card information is stored on the Site.
8.4 Protection Against Malware and Unauthorized Access

The Site is regularly scanned for malware.

Intrusion detection and prevention systems protect against unauthorized access attempts.
8.5 User Responsibility

Users are responsible for securing their account passwords.

Users bear responsibility for damages resulting from unauthorized use of their accounts.
8.6 Security Breach Notification

Users can report any security breaches or suspicious activities to info@cartographero.com.

Cartographero commits to taking necessary technical measures as soon as possible.
9. Comment and Content Publication Policy
9.1 Responsibility

Users are fully responsible for any comments, evaluations, suggestions, visuals, or other content they submit.

Cartographero does not guarantee the accuracy of user-submitted content and is not liable for any legal, penal, or commercial consequences arising from such content.
9.2 Publication Principles

Content containing attacks on personal rights, hate speech, racism, violence, sexuality, political propaganda, religious discrimination, misleading information, illegal content, or commercial advertising is strictly prohibited.

Such content may be removed without prior notice.
9.3 Pre-Approval and Consent

Comments submitted by users are subject to Cartographero’s prior approval.

Submission does not guarantee publication.
9.4 Right to Modify or Delete

Cartographero reserves the right to modify, delete, or restrict access to any user content due to technical, legal, or policy violations.
9.5 Personal Data Protection

Personal information voluntarily disclosed in comments or content is not separately processed by Cartographero.
9.6 Violation Reporting

Users can report content violating policies to info@cartographero.com to request removal.
10. Limitation of Liability

Cartographero Mapping and Software Technologies Ltd. is not responsible for any direct or indirect damages resulting from access to or use of the Site or its content.

No guarantees are made regarding uninterrupted, error-free, virus-free, or fitness-for-purpose operation of the Site services.
10.2 Technical Failures and Service Interruptions

Cartographero is not liable for any damages arising from service interruptions, errors, data loss, delays, unauthorized access, viruses, or other technical problems affecting the Site or its extensions.
10.3 Third-Party Websites

Cartographero is not responsible for content on third-party websites linked from the Site.

Access to third-party sites is at the User’s own risk.
10.4 User Responsibility

Users agree not to infringe third-party rights while using Cartographero’s services.

Users accept full legal and penal responsibility for actions conducted via the Site.
11. Force Majeure
11.1. Definition of Force Majeure

Events beyond Cartographero's control, such as natural disasters (earthquake, flood, fire, storm, etc.), war, terrorist attacks, strikes, lockouts, cyber-attacks, pandemics, legal regulations, or government interventions, shall be considered “Force Majeure.”
11.2. Obligations of the Parties

In the event of a force majeure, Cartographero reserves the right to temporarily suspend or be unable to perform the relevant services.

Cartographero shall not be held liable for any compensation arising from force majeure events.
11.3. Notification
-
In the event of a force majeure, Cartographero shall make reasonable efforts to inform users as soon as reasonably possible.
12. Termination of the Agreement
12.1. Right of Termination by Cartographero

Cartographero reserves the right to suspend, terminate, or restrict access to a membership if the Member violates the terms of this Agreement or the Terms of Use.
-
Cartographero may also terminate the membership or suspend its services entirely at its sole discretion without providing any justification.
12.2. Right of Termination by the Member
-
The Member has the right to cancel their membership and close their account at any time without providing any justification.
-
To terminate their membership, the Member must contact Cartographero and submit a termination request.
12.3. Member’s Obligations
-
The Member accepts responsibility for any actions taken before termination and for any damage caused to Cartographero and/or third parties.
-
Even after termination, the Member remains personally liable for any direct or indirect damages arising from their actions during the term of their membership.
13. Notices and Evidence Agreement
13.1. Notification Addresses
-
The parties agree that the email addresses provided during the membership registration process shall be deemed their official notification addresses.
-
Any notification sent by Cartographero to the email address provided by the Member shall be considered legally delivered at the time of sending.
13.2. Evidence Agreement
-
The Member agrees that Cartographero’s system records, electronic log files, database records, and email correspondence shall constitute conclusive and binding evidence.
-
These records shall be accepted as valid and binding in the resolution of any disputes arising between the Parties.
14. Governing Law and Jurisdiction
14.1. Governing Law
-
The interpretation and enforcement of this Agreement, and any disputes arising from it, shall be governed by the laws of the Republic of Türkiye.
14.2. Jurisdiction
-
The Parties agree that the courts and enforcement offices of Istanbul Anadolu shall have jurisdiction over any disputes arising from this Agreement.
-
Cartographero also reserves the right to initiate legal proceedings in the jurisdiction where the Member resides.
15. Compensation and Liability
15.1. In Case of Breach and Consequences
-
If the User acts in violation of the provisions of this Agreement, uses the website content without written permission, or engages in statements, comments, or actions that may harm Cartographero’s brand value, commercial reputation, or credibility, the User agrees, declares, and undertakes to indemnify Cartographero immediately and in full for all direct and indirect damages, including court costs and attorney fees, upon first request.
15.2. Right to Claim Compensation

In the event of such violations, Cartographero also reserves the right to file a lawsuit for material and moral damages.
-
All administrative, legal, and criminal liabilities arising before third parties or public authorities due to the User’s actions shall solely belong to the User.
16. Enforcement and Acceptance
16.1. Enforcement

This “Cartographero Membership and Website Terms of Use Agreement” shall enter into force as of the date of its publication on www.cartographero.com.
-
In case of any updates or amendments to the Agreement, the new version shall come into effect on the date of publication.
16.2. Acceptance
-
By accessing the site and continuing to use it, the Member and User declare, acknowledge, and undertake that they have read, understood, and accepted all provisions of this Agreement.
-
Users also agree to regularly check for any changes made by Cartographero and acknowledge that they shall not claim ignorance of such changes.
